Resumen
Access to traffic data and information services for law enforcement purposes is an accepted tool for investigation and intelligence service. Policies regarding lawful access to traffic data, however, are increasingly set in technology-neutral language, while language and policies are often discussed at closed international forums. In days of plain old telephone systems, the content of communications was considered sensitive and its interception required constraints from legal authorities. This rule did not apply to traffic data as it was considered less invasive, demanding minimum legal constraint. Most significant fields in traffic data include date and time of the start of the call, duration of the call and caller and receiver phone numbers. The landscape for lawful access to traffic data remains quite fragmented even today. In Great Britain, law separates unique reference links from traffic data and practices very weak access constraints, but the U.S. has stronger access protections and has no retention requirements.
